Terms of Service

1. Nature of Services
Defy Elite Athletics provides remote coaching, training programming, performance education, and related digital services. Services are educational and coaching-based in nature and do not constitute medical care, physical therapy, diagnosis, treatment, emergency supervision, or any other licensed healthcare service.
2. Assumption of Risk
Athletic training, exercise participation, skill practice, and performance development involve inherent and unavoidable risks, including but not limited to strain, sprain, aggravation of existing conditions, falls, collision, illness, and more serious injury. By using these services, the participant voluntarily accepts those risks.
3. Medical Clearance and Participant Responsibility
The participant is responsible for determining whether participation is appropriate. Where relevant, the participant should obtain medical clearance before beginning or continuing training. The participant agrees to stop activity and seek qualified medical attention if pain, dizziness, shortness of breath, illness, or other warning signs arise.
4. No Guarantee of Results
Performance outcomes depend on many variables outside the control of Defy Elite Athletics, including adherence, sleep, nutrition, training history, injury status, stress, and competitive context. No promise, guarantee, or warranty is made regarding specific results.
5. Minors and Guardian Consent
Participants under 18 may only use the services with the knowledge, consent, and involvement of a parent or legal guardian. The parent or guardian accepts responsibility for the minor’s participation, oversight, transportation where relevant, and all acknowledgments required by these Terms.
6. Remote Delivery and Supervision Limits
Services may be delivered remotely through digital communication, recorded analysis, written programming, and asynchronous feedback. The participant understands that remote coaching has limits and does not create continuous real-time supervision of exercise execution, environment, equipment setup, or third-party conduct.
7. Release and Limitation of Liability
To the maximum extent permitted by applicable law, the participant releases and agrees not to hold Defy Elite Athletics, Defy LLC, and their owners, officers, contractors, agents, and representatives liable for claims, losses, damages, or expenses arising from participation in training or use of the services, except where liability cannot legally be excluded.
8. Compliance With Instructions and Honest Disclosures
The participant agrees to provide accurate intake information, disclose known injuries or limitations, follow coaching instructions responsibly, and avoid participating beyond safe capacity. Failure to provide accurate information may materially affect coaching quality and safety.
9. Payments, Access, and Refund Policy
Paid access, billing cadence, cancellation terms, and any refund or credit rules must be stated clearly at checkout or in the applicable service agreement before payment is collected. No public payment flow should go live until those terms are finalized.
10. Contact and Updates
These Terms may be updated as operations mature. The version presented at the time of onboarding should be retained for audit purposes in the production workflow.
